Terms:

This agreement has been freely negotiated and contains the entire understanding between Belle Verdiglione and you (the Client). It supersedes any existing agreements between the parties. If any provision of this agreement is held to be invalid or enforceable under the law, the validity of this agreement as a whole shall not be affected, and the other provisions of the agreement shall remain in full force and effect. You (the Client) agree that the terms of this service shall be governed by the laws of the State of Western Australia, notwithstanding its conflicts of laws provisions.

By deciding to join The Camera Queens you confirm your acknowledgement of having read, understood and agreed to the terms and conditions within this agreement. These terms dictate your use of each individual service offered in conjunction with the program offered by Django and Lola Pty Ltd as Trustee for the PBOI Family Trust T/As Belle Verdiglione Photography ABN 78 584 838 438.

RETURN POLICY

Please note that all sales are in AUD and are final. There will be no refunds or cancellations however your place may be transferable to another person prior to the commencement date of your initial 12 month period upon a written request by you (the Client) and approval in writing by Belle Verdiglione via email [email protected].

In the unlikely event cancellation is requested within the initial 12 month period, comprehensive consideration will be undertaken and a discretionary refund may (but is not obliged to) be offered by Belle Verdiglione minus a $100.00 administration fee should the cancellation be approved.

In the event you (the Client) fail to make a scheduled payment as agreed to by these terms and conditions, Belle Verdiglione reserves the right to pursue payment via the full extent of the Australian law.

Belle Verdiglione reserves the right to update / amend pricing of the Camera Queens program on her website at her discretion and without providing notification to you.

LIMIT OF LIABILITY

In the unlikely event that the Photographer is injured or becomes too ill to provide the agreed and expected services, responsibility and liability is limited to the return of all payments received for the course/workshop/event package.

Belle Verdiglione may revoke your access to the Camera Queens in the event she deems your actions / attitude / behaviour is not respectful and inclusive of all other members or if you make any hateful or discriminatory comments regarding race, ethnicity, religion, disability, sexual orientation or political beliefs. You accept that if you engage in any such conduct, then you will be removed from the Program, without a refund.

PERMISSION TO REPRODUCE

The course/workshop/event may be recorded and may be reproduced. Please contact Belle Verdiglione via email [email protected] if you do not wished to be photographed, filmed or otherwise recorded.

PRIVACY POLICY

Belle Verdiglione will adhere to the Australian privacy laws and not disclose your personal details to anyone.

NON DISCLOSURE AGREEMENT

You (the Client) acknowledge that you are privy to confidential and private information and understand that Belle Verdiglione owns Intellectual Property of the contents contained within this course/workshop/event. By purchasing this product, you (the Client) agree that you will not on-sell, disseminate, distribute, screen shot or forward any information you receive as part of this course/workshop/event including, but not limited to, private and public online forums, emails, social media and other persons not involved in this course.

EXCLUSION OF COMPETITORS

If you are in the business of creating similar documents, goods or services for the purpose of providing them for a fee to users, whether they be business users or domestic users, then you are a competitor of Belle Verdiglione. Belle Verdiglione expressly excludes and does not permit you to use or access the Camera Queens, to download any documents or information from the private Facebook group or associated email correspondence or obtain any such documents or information through a third party. If you breach this term then Belle Verdiglione will hold you fully responsible for any loss that she may sustain and further hold you accountable for all profits that you might make from such unpermitted and improper use. Belle Verdiglione reserves the right to exclude and deny any person access to the Camera Queens, services or information in her sole discretion.

COPYRIGHT, TRADEMARK AND RESTRICTIONS OF USE

The Camera Queens contains material which is owned by or licensed to us. This material includes, but is not limited to, the design, layout, look, appearance, trademarks and graphics. You are not permitted to reproduce the documents, information or materials relating to or associated with the Camera Queens for the purposes of sale or the use by any third party. In particular you are not permitted to republish, upload, transmit electronically or otherwise or distribute any of the materials, documents or products that may be available for use or download from time to time in the private Facebook group or associated email correspondence.

Belle Verdiglione expressly reserves all copyright and trademark in all documents, information and materials on our website and we reserve the right to take action against you if you breach any of these terms.

Any redistribution or reproduction of part or all of the contents in any form is prohibited other than the following: you may print or download to a local hard disk extracts for your personal and non-commercial use only; and you may copy the content to individual third parties for their personal use, but only if you acknowledge Belle Verdiglione as the source of the material.

You may not, except with our express written permission, distribute or commercially exploit the content. Nor may you transmit it or store it in any other website or other form of electronic retrieval system.
